The Wrecked, Abandoned or Hazardous Vessels Act, known by its acronym WAHVA, was waiting to be proclaimed into force. That proclamation has now issued, and WAHVA will come into force on July 30, 2019. The Canada Gazette publication today of the proclamation can be found here at page 2300.
It will be recalled that WAHVA enacts for Canada the Wreck Removal Convention of 2007, as well as the Salvage Convention of 1989.
There is also a comprehensive regime for dealing with so-called “dilapidated vessels” and wrecks (actual or feared). Measures can include dismantling, sale, etc.
